This year marks the 27th anniversary of the landmark Olmstead v. L.C. Supreme Court decision, a ruling that affirmed the right of people with disabilities to live and receive services in their own communities rather than in institutional settings whenever appropriate.
As shared by our partners at the California Department of Developmental Services (DDS), the Olmstead Decision remains a critical milestone in advancing the rights of people with disabilities across the United States.
On June 22, 1999, the Supreme Court concluded in Olmstead that placing people with disabilities in institutions when they may appropriately reside in a less restrictive, community setting violates the Americans with Disabilities Act (ADA). The case was led by Lois Curtis and Elaine Wilson, two women who fought for the opportunity to leave an institution and live in their communities with the supports they needed.
In California, the principles of Olmstead are reinforced through the Lanterman Act, which guarantees that individuals with intellectual and developmental disabilities are entitled to receive the developmental services they need in the least restrictive setting possible. These community-based services are provided to eligible individuals through California’s 21 nonprofit regional centers, helping thousands of individuals live, learn, work, and participate fully in their communities.
Today, we celebrate the lasting impact of the Olmstead Decision, the leadership and advocacy of Lois Curtis and Elaine Wilson, and the many contributions people with intellectual and developmental disabilities make in our communities every day. California continues to reaffirm its commitment to providing the services and supports individuals need to thrive in the communities of their choice.
